Vezity Performance ("we," "our," or "us") provides fitness coaching services through our website and associated platforms. By accessing or using our services, you agree to comply with and be bound by these Terms of Service.

2. Services Description

Vezity Performance operates as a coaching platform connecting clients with certified fitness trainers. Our services include:

• Personal Training (in-person coaching)
• Online Coaching (remote programming and support)
• Corporate Wellness programs
• Fitness assessments and consultations

We match clients with trainers based on goals, location, and preferences. Trainers operate independently within the Vezity Performance framework.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a contract
• Complete a health screening questionnaire
• Disclose any medical conditions or injuries

4. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information
• Follow your trainer's instructions and program
• Notify us of any changes to your health status
• Attend scheduled sessions or provide adequate notice for cancellations
• Use services for personal, non-commercial purposes only
• Not share login credentials or program materials

5. Trainer Relationship

Vezity Performance trainers are independent professionals who:

• Operate within our quality standards and framework
• Maintain their own insurance and certifications
• Set their own schedules and availability
• Are responsible for their own tax obligations

While we vet trainers, we are not responsible for individual trainer conduct. Disputes between clients and trainers should be reported to us for mediation.

6. Payments and Fees

6.1 Pricing

We maintain standardized pricing across all trainers:

• Personal Training: From R850 per session (packages available)
• Online Coaching: From R1,950 per month
• Corporate Wellness: Custom pricing based on requirements

6.2 Payment Terms

• Payments are due in advance for services
• We accept major credit cards and electronic transfers
• Late payments may result in service suspension
• Prices are subject to change with 30 days' notice

6.3 Refund Policy

Refunds are considered on a case-by-case basis:

• Session cancellations within 24 hours may incur fees
• Monthly subscriptions are non-refundable after 7 days
• Medical exceptions require documentation

7. Cancellation and Rescheduling

Clients must provide at least 24 hours' notice for cancellations or rescheduling. Late cancellations may result in session forfeiture or charges. Trainers may cancel sessions due to illness or emergency with appropriate notice.

All content on our website and training materials are protected by copyright and trademark laws. You may not:

• Copy, distribute, or modify our content without permission
• Use our branding or trademarks without authorization
• Reverse engineer or attempt to extract source code

10. Limitation of Liability

To the fullest extent permitted by law, Vezity Performance shall not be liable for:

• Any indirect, incidental, or consequential damages
• Personal injury or property damage resulting from training
• Loss of data or business interruption
• Actions or omissions of individual trainers

Our total liability shall not exceed the amount paid for services in the preceding 12 months.

11. Termination

We may terminate or suspend your access to services if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Fail to make payments
• Create risk or legal exposure for us

You may terminate services by providing written notice. Outstanding fees remain payable.

12. Dispute Resolution

Any disputes shall be resolved through mediation in Johannesburg, South Africa. If mediation fails, disputes shall be settled in accordance with South African law.

13. Changes to Terms

We may modify these terms at any time. Continued use of services after changes constitutes acceptance. We will notify you of material changes via email or website notice.

14. Governing Law

These Terms shall be governed by the laws of South Africa, without regard to conflict of law principles.
